Man gets withheld judgment in gun case

Aggravated assault charge stems from bar incident

A Hailey man has been given a withheld judgment in an aggravated assault case that arose earlier this year when he pulled a revolver and fired it into the ground during an altercation with another man outside of a Hailey bar.

Sentencing for Gino Renatto Costa, 22, was pronounced Monday by Judge Robert Elgee in Blaine County 5th District Court. Costa was also placed on probation for three years and fined $2,500. The withheld judgment provides that the felony conviction can be removed from Costa’s criminal record if he successfully completes probation.

Costa pleaded guilty to the charge in July.

The charge against him arose on Jan. 8 in the parking lot at the Sun Valley Brewing Co. on Main Street in Hailey. Hailey police reported then that Costa and the other man became involved in an argument when two women were fighting in the bar parking lot.

Costa, who was arrested following the incident, had been free on $10,000 bond following an initial court appearance on the charge on Jan. 10 in Blaine County Magistrate Court.
