Judge withholds DUI felony

Driving privileges granted during probation

Ketchum resident Colin Scott Muldoon was sentenced Monday to 30 days in jail for a felony DUI in Sun Valley. If Muldoon follows the terms of his sentence, which include drug court and jail time, his conviction could be reduced to a misdemeanor or removed from his record, said 5th District Judge Robert Elgee, who handed down the sentence.

Elgee said that although Muldoon has been doing well with his rehabilitation efforts and will complete 45 days of drug court, jail time is still appropriate for a felony DUI.

Following arrest on Jan. 12 by Sun Valley police, Muldoon was charged with a felony because he had two prior misdemeanor DUI convictions in the last 10 years. He was convicted of misdemeanor DUI in Latah County in 2003 and in Ada County in 2006. 

Muldoon’s license was suspended and will remain so until Feb. 11, but he will have driving privileges to get to work, Alcoholics Anonymous meetings, drug court and jail. He is to serve 29 days in the Blaine County jail due to one day of credit.

“You have been doing well. It’s a good thing to see,” Elgee told Muldoon in the courtroom Monday.

A felony charge and further punishment could await Muldoon if he fails to follow through with the terms of his sentence during a three-year probation that started Monday. He was also ordered to pay a $1,000 fine and court costs.
