Bellevue marshal alleges felony

Former Bellevue Mayor Jon Anderson is facing another DUI charge for allegedly driving under the influence Saturday afternoon in Bellevue.

Bellevue Marshal Bryan Carpita said Tuesday that Anderson was arrested on a felony charge because of a 2005 misdemeanor DUI conviction in Blaine County and a pending misdemeanor DUI charge in Lincoln County. A felony charge can be applied when a suspect has had two prior DUI convictions within the past 10 years.

Anderson remained incarcerated in the Blaine County jail until Tuesday, when he was arraigned in Blaine County Magistrate Court. He had not been released from custody by Tuesday afternoon.

Anderson was Bellevue's mayor from 2005 until late June of this year when he submitted a letter of resignation. He cited "personal and family health issues" as his reasons for resigning. He was arrested on May 26 for allegedly driving under the influence in Lincoln County.

A jury trial was scheduled to start today in the Lincoln County case. However, the trial was canceled after a plea agreement was reached with the Lincoln County Prosecuting Attorney's Office. Terms of the agreement were not available by press deadline Tuesday.

Anderson's latest arrest occurred shortly after 2 p.m. on Saturday near the intersection of Cedar and Fifth streets in Bellevue.

"Basically, he was stopped because it was known that he was suspended," said Carpita, referring to a driver's license suspension resulting from the Lincoln County case against Anderson. Carpita said the deputy reported the smell of alcohol on Anderson after making the traffic stop and that Anderson failed several field sobriety tests.

According to Blaine County court records, in the 2005 misdemeanor DUI conviction, Anderson was given a suspended 180-day jail sentence, fined $790.50 and placed on probation for six months.
