A 22-year-old Blaine County man was sentenced this week to 90 days in jail after pleading guilty to misdemeanor domestic battery against his fiancée.
Rafael Diaz-Rodriguez was originally charged with a felony, but pleaded guilty to a reduced charge Tuesday in Blaine County Magistrate Court. Judge R. Ted Israel also placed Diaz-Rodriguez on two years probation and ordered him to pay $867.50 in fines, court costs and public defender fees and to undergo a domestic violence evaluation.
Probable-cause affidavits filed by Hailey police allege that Diaz-Rodriguez battered his fiancée on two separate occasions, the first on July 5 at the couple's residence on Bullion Street and the second on July 26 at the same location. Police alleged that the first incident happened because the woman wouldn't give Diaz-Rodriguez $50 to buy fireworks and the second because she refused to let him take the couple's 8-month-old daughter.
According to police reports, the woman suffered two fracture lines on the bridge of her nose in the second incident.
Court records do not indicate whether Diaz-Rodriguez and the woman are still engaged. Court records do state that Diaz-Rodriguez has past misdemeanor convictions in Blaine County for disturbing the peace, injury to a child, resisting arrest, possession of drug paraphernalia and racing on a public highway.
