Jury trial set in rape case

A May 4 jury trial has been scheduled for a 21-year-old Hailey man charged with rape for allegedly having sexual intercourse with a 15-year-old Bellevue girl.

Mauro Z. Nuñez was arraigned on the charge Monday before Judge Robert J. Elgee in Blaine County 5th District Court. Elgee informed Nunez that the crime is punishable by up to life in prison. Nuñez pleaded not guilty.

Nuñez is accused of having sex with the girl at his parents' home in Hailey on Oct. 23. He was charged with the crime on Nov. 13 following an investigation by Hailey police. He remains incarcerated in the Blaine County jail on $75,000 bond.

Nuñez now faces a probation violation charge for an earlier conviction of felony injury to a child. He was originally charged with rape in that case for having sex with another 15-year-old Bellevue girl in 2007. After pleading guilty to the lesser charge, Nuñez was sentenced to 90 days in jail and three years probation.

An evidentiary hearing before Elgee on the probation violation charge is scheduled for Jan. 4.
