Evan Bear gets 88 days in jail

Sentence pronounced in police battery case

A Blaine County man who was earlier charged with a felony count of battering a police officer was sentenced Monday to 88 days in jail after pleading guilty to a lesser misdemeanor crime.

Judge R. Ted Israel pronounced sentence Monday in Blaine County Magistrate Court for 47-year-old Evan Glenn Bear, who court records state now lives in Sun Valley.

Bear was also fined $100. A provision of his jail sentence allows work release while incarcerated.

In a plea agreement with the Blaine County Prosecuting Attorney's Office, Bear pleaded guilty in September to "assault or battery upon certain personnel," a crime typically applicable to battery upon a government official excluding on-duty police officers.

In exchange for his guilty plea, the felony charge was reduced and misdemeanor counts of property damage and domestic battery were dismissed.

Bear was arrested on Dec. 8, 2008, at his wife's home in Bellevue. He had allegedly locked himself in a bathroom and injured Bellevue Marshal's Deputy Rene Rodriguez when police tried to remove him.

Court records state that Bear and his wife were separated at the time of the incident. Records further state that a divorce was finalized between the couple in July.
