Camas businessman’s lawsuit appeals grow

Appeals, rulings, continue

Camas County resident George Martin continues his battle against county zoning rules.

Camas County businessman George Martin Jr. is living proof of the adage, "win some, lose some."

However, tracking Martin's lawsuits against Camas County isn't easy.

On Tuesday, Fifth District Judge Robert Elgee said he would sign an order overturning Camas County's 2007 comprehensive plan as illegal. Martin won the suit originally. But Camas County appealed to Federal District Court, which rejected the appeal and sent the case back to Judge Elgee, who in effect reinstated his December 2008 order against Camas County.

That's a Martin win.

Meanwhile, Camas County redrafted and enacted essentially the same comprehensive plan in 2008, which Martin also challenged in court. In that lawsuit, another Fifth District jurist, Judge John Butler, rejected Martin as lacking standing to claim damages.

That's a loss for Martin.

However, Camas County is appealing Judge Elgee's original ruling on the 2007 comp plan and Martin's attorney, Chris Simms, said Judge Butler's decision on the 2008 plan would be appealed.
