A 20-year-old Hailey man who had been accused of having sex with an underage girl in a public restroom has been given a chance at rehabilitation after pleading guilty to felony injury to a child.
Richard D. Nieves was sentenced to the "rider program" Tuesday by Judge Barry Wood in Blaine County 5th District Court. Under the rider program, which is also referred to as "retained jurisdiction," Nieves is to serve 180 days at the Idaho Department of Correction's North Idaho Correctional Institution in Cottonwood.
If the rehabilitation is deemed to have failed, Wood imposed an alternative seven-year prison sentence, with four years to be served before parole eligibility.
Nieves was charged last July with two counts of lewd conduct with a minor child after Hailey Police Lt. Steve England allegedly caught Nieves engaged in sex acts with a 15-year-old girl in the women's restroom at Lawrence Heagle City Park in Hailey.

In exchange for Nieves' guilty plea to felony injury to a child, the two lewd conduct charges were dismissed.
According to Blaine County court records, Nieves has multiple prior convictions both as a juvenile and as an adult. His convictions include several counts of alcohol consumption by a minor, several counts of probation violation, disturbing the peace, burglary, petit theft and minor possession of tobacco.
