Copyright lawsuit settled out of court

Sun Valley Magazine apologizes to Express Publishing


A copyright infringement lawsuit pending in U.S. District Court by Express Publishing Inc. against the owners of Sun Valley Magazine has been settled.

As part of the settlement, Sun Valley Magazine issued an apology to Express that states, "Sun Valley Magazine regrets any inadvertent copying of certain portions of Express Publishing's Tables Dining Guide, and will take appropriate measures to avoid such instances in the future."

The two parties agreed in mid-January to resolve the case, which had been litigated for nearly a year.

Express had alleged that Sun Valley Magazine violated federal copyright law when it published content from Express's Tables dining guide.

The court accepted the settlement and dismissed the case.

Two owners of Sun Valley Magazine named as defendants in the case were HPJ Valley Publishing LLC of Delaware and Valley Publishing LLC of Idaho.

Express Publishing Inc. of Idaho is a local company that publishes the twice-weekly Idaho Mountain Express newspaper, the Sun Valley Guide magazine and Tables dining guide.
