In March, when I appeared in front of you and the City Council, I expressed some concern with the existing legal services agreement with Rand Peebles and the annual costs associated with this services contract.

The contract calls for an $80,000 annual retainer and a maximum for "covered services" of $92,500 per year.

In March, you stated that the September 2004 legal services contract with Rand has resulted in less costs to the city than previous contracts. A summary of the costs for each year in Sun Valley from 2000 to 2007 shows that the costs since the new agreement in 2004 far exceed previous year's payments. The annual average is $95,100 prior to 2004 while it is $250,700 from 2004 to present. This does not match your previous statements about past costs and I would appreciate any further data you have to support your statements.

The Legal Services contract calls for City Council action and approval for expending more than $92,500 in "covered expenses" each year. Thus far I cannot see any council action relating to the $321,900 spent in 2007 or the $231,00 spent in 2006 reflecting council oversight of the contract expenditures.

I would appreciate any feedback as my concerns relate to the total expenditures each year under the contract and the City Council oversight, a process you would manage as the mayor. Based on your encouragement in March, I will now be working with city staff to analyze the monthly bills in light of the $92,500 limit each year for "covered services."

Thank you for this opportunity to review our city services. City staff have been most helpful in this data gathering. I look forward to this continued process.
