An East Magic Reservoir man faces a charge of aggravated assault for allegedly brandishing a 12-gauge shotgun during a dispute with a neighbor.
The Blaine County Sheriff's Office reported that 39-year-old Steven A. Cain was arrested Saturday night after deputies were called at about 9:30 p.m. to the East Magic area on Magic Reservoir, an impoundment on the Big Wood River in southern Blaine County.
Sheriff's spokesman Sgt. Jay Davis said Cain is accused of pointing a gun at his neighbor, Nathaniel North, 35, during a dispute over landscaping. Davis said Cain had made an earthen berm that North thought was encroaching into a roadway, so North was removing it with a Bobcat loader.
Davis said Cain was in his house when he heard a scraping noise and allegedly "picked up his shotgun, made sure it was unloaded, and went outside and told North to get off his property."
Loaded or not, pointing a gun at someone is a crime, Davis said.
Cain was transported to the Blaine County Jail. He was arraigned on a felony charge of aggravated assault Monday afternoon in Blaine County Magistrate Court and released later that day after posting $1,500 bond.
Davis said officers are still investigating to see if any laws were broken in the building of the berm or its demolition.
