Accused Hailey rapist pleads guilty

Sentencing for lewd conduct set for February

A man accused of raping two Hailey girls last summer pleaded guilty Monday to a single felony count of lewd conduct with a minor child under 16.

Emmanuel Bautista-Aguayo, 22, of Hailey, entered his guilty plea before Blaine County 5th District Court Judge Robert J. Elgee. His alleged companion in the case, Jose Vivar-Olivera, 22, also of Hailey, pleaded guilty to the same charge on Dec. 11.

Bautista-Aguayo and Vivar-Olivera were accused of coercing two Hailey girls, ages 12 and 13, into a vehicle on July 26, giving them an intoxicating beverage, driving them to a remote area up Slaughterhouse Canyon and having sex with them.

A Blaine County grand jury in August indicted Bautista-Aguayo on two counts of rape and two counts of "feloniously administering an intoxicating substance to another with intent to commit a felony."

According to court records, Bautista-Aguayo told Elgee at his change of plea hearing that he was "drunk at the time of the incident and knows it was wrong."

Sentencing for both Bautista-Aguayo and Vivar-Olivera has been scheduled for Feb. 12. Both men remain incarcerated in the Blaine County Jail.

Under Idaho law, conviction of lewd conduct with a minor child under 16 is punishable by up to life in prison and a $50,000 fine.
