Teen arrested for
rape of 12-year-old

A
14-year-old Bellevue boy has been charged with the rape of a 12-year-old
girl in Bellevue last week.
During an
arraignment Friday in Twin Falls, 5th District Court Judge
John Varin ruled that under Idaho code, Charles Drake must be tried as
an adult, and set bail at $100,000. Drake was transported to the
Mini-Cassia Detention Facility in Burley pending a preliminary hearing
July 31.
Bellevue
Marshal Randy Tremble said the events that led to Drake’s arrest began
at 3:15 a.m. Thursday when his office received a report of a local
15-year-old boy missing from an outdoor party along a diversion canal
near Broadford Road.
"Pursuant
to that investigation, we determined that a sexual assault had
occurred," he said.
He said
deputies found a "highly intoxicated" 12-year-old girl, who
appeared to be the victim of the assault.
Drake was
arrested at 10:50 p.m. Thursday at his home in Bellevue.
Under
Idaho law, any act of sexual intercourse by any perpetrator with a
female under 18 years old is considered rape. If the defendant in a rape
case is 14 or older, he must be tried as an adult.
